Court hears arguments on behalf of Samir Modi, police oppose bail plea

At the outset, Senior Advocate Tanveer Ahmed Mir requested the court to hear arguments on camera. Consequently, the hearing was conducted in camera (closed session). The court has listed the bail plea for hearing on Tuesday.

Meanwhile, Judicial Magistrate First Class (JMFC) extended the judicial custody of Samir Modi until October 6. He was produced before the court after the expiry of one day’s judicial custody.

Delhi Police filed a reply on Saturday opposing the bail plea of businessman Samir Modi.

Senior Advocates Ramesh Gupta, along with Advocates Punit Mittal, Shailendra Singh, Ishaan Jain, and Surya Pratap Singh, appeared for Samir Modi. On the other hand, Senior Advocate Tanveer Ahmed Mir, along with Shubham Mahajan and Ravish Thakur, represented the complainant.

During the hearing on Saturday, Senior Advocate Ramesh Gupta contended that a Look-Out Circular (LOC) can be issued within five days of an FIR being registered. He submitted that the FIR in this case was registered on September 10, and the LOC was issued within four days.

It was further submitted that Samir Modi traveled to London on a return ticket, returned from London, and was detained at the airport before being handed over to the police on September 18.

The counsel requested the court to inquire with the police about how an LOC could be issued within four days. Additionally, he urged the court to direct the police to investigate the complaint filed by the accused, alleging extortion by the complainant.

Additional Sessions Judge Vipin Kharb expressed his interest in understanding how the LOC was issued within four days.

On September 19, the Saket Court granted a two-day further remand of Samir Modi to the Delhi Police. He was subsequently sent to judicial custody on Sunday. The court also asked the police to look into the complaint filed by Samir Modi.

The court conducted the hearing on Friday in camera, requesting the media and others to leave the courtroom. Senior Advocate Ramesh Gupta noted that bail plea hearings are typically not conducted in camera. Nevertheless, the court insisted on the closed-door session.
