Two TVK functionaries sent to 14-day judicial custody in Karur stampede case

Two office bearers of the Tamilaga Vettri Kazhagam (TVK) were sentenced on Tuesday to 14 days’ judicial custody in connection with the stampede that occurred during a party rally. The tragic incident, which took place on September 27, resulted in the death of 41 people and left nearly 60 injured, according to police reports.

The accused are TVK’s Karur West District Secretary, V P Mathiyalagan, and Karur Central District Secretary, Kasi Pounraj. Both were named in the First Information Report (FIR) and have been remanded to judicial custody.

Additionally, TVK state general secretary Bussy Anand and deputy general secretary Nirmal Kumar have also been named in the FIR, but they are yet to be arrested, police confirmed.

The accused have been booked under several sections of the Bharatiya Nyaya Sanhita, including:

– Section 105: Culpable homicide not amounting to murder
– Section 110: Attempt to commit culpable homicide
– Section 125: Endangering life of others
– Section 223: Disobedience to order

In response to the incident, the Tamil Nadu government has constituted a one-member commission, headed by retired judge Aruna Jagadeesan, to probe the alleged stampede during the TVK chief’s rally in Karur on September 27.

A Delhi court has granted bail to Gaganpreet Kaur, the accused in a fatal BMW crash that resulted in the death of a senior Finance Ministry official. The Patiala House Court approved her bail on a bond of ₹1 lakh, along with two sureties.

The court imposed several conditions for her release, including the surrender of her passport and a requirement to be present at every hearing related to the case.

**Ambulance Scrutiny: Questions Raised Over Negligence**

During proceedings, the court questioned the negligence of the ambulance that arrived at the accident site. Although the ambulance reportedly reached within seconds, it failed to take the injured to the hospital promptly.

The court remarked, “What should be done with this ambulance? Are they not accused of the offense of death due to a negligent act?” indicating serious concerns regarding the emergency response.

**Crash Details and Aftermath**

The accident took place near Dhaula Kuan when Gaganpreet Kaur’s BMW collided with a motorcycle carrying Navjot Singh, Deputy Secretary in the Department of Economic Affairs, and his wife, Sandeep Kaur.

Tragically, Singh succumbed to his injuries, while his wife sustained critical injuries. Investigations revealed that the couple was transported to Nulife Hospital in North Delhi, approximately 19 kilometers away from the accident location.

Singh’s family has alleged that valuable time was lost because the victims were not urgently taken to a nearby hospital.

**Legal Proceedings**

Gaganpreet Kaur has been charged with culpable homicide not amounting to murder, among other offenses under the Bharatiya Nyaya Sanhita. She is currently in judicial custody but has now been granted bail under strict conditions.

Kaur defended her actions by stating that she panicked after the accident and took the injured couple to a hospital she was familiar with.

The case continues to develop as the investigation and legal process proceed.

Court hears arguments on behalf of Samir Modi, police oppose bail plea

At the outset, Senior Advocate Tanveer Ahmed Mir requested the court to hear arguments on camera. Consequently, the hearing was conducted in camera (closed session). The court has listed the bail plea for hearing on Tuesday.

Meanwhile, Judicial Magistrate First Class (JMFC) extended the judicial custody of Samir Modi until October 6. He was produced before the court after the expiry of one day’s judicial custody.

Delhi Police filed a reply on Saturday opposing the bail plea of businessman Samir Modi.

Senior Advocates Ramesh Gupta, along with Advocates Punit Mittal, Shailendra Singh, Ishaan Jain, and Surya Pratap Singh, appeared for Samir Modi. On the other hand, Senior Advocate Tanveer Ahmed Mir, along with Shubham Mahajan and Ravish Thakur, represented the complainant.

During the hearing on Saturday, Senior Advocate Ramesh Gupta contended that a Look-Out Circular (LOC) can be issued within five days of an FIR being registered. He submitted that the FIR in this case was registered on September 10, and the LOC was issued within four days.

It was further submitted that Samir Modi traveled to London on a return ticket, returned from London, and was detained at the airport before being handed over to the police on September 18.

The counsel requested the court to inquire with the police about how an LOC could be issued within four days. Additionally, he urged the court to direct the police to investigate the complaint filed by the accused, alleging extortion by the complainant.

Additional Sessions Judge Vipin Kharb expressed his interest in understanding how the LOC was issued within four days.

On September 19, the Saket Court granted a two-day further remand of Samir Modi to the Delhi Police. He was subsequently sent to judicial custody on Sunday. The court also asked the police to look into the complaint filed by Samir Modi.

The court conducted the hearing on Friday in camera, requesting the media and others to leave the courtroom. Senior Advocate Ramesh Gupta noted that bail plea hearings are typically not conducted in camera. Nevertheless, the court insisted on the closed-door session.

BMW accident: Delhi court says CCTV footage cannot be shared with accused

Advocate Gagan Bhatnagar, representing Kaur, argued that the case hinged on CCTV footage from Dhaula Kuan metro pillars 65 and 67, and that examining it could reveal additional details. However, the magistrate stated that there is no law permitting the footage to be provided to the accused, reported PTI.

Kaur’s counsel responded, “I am not saying give it to me but to preserve it and submit it in the court.”

Bhatnagar further alleged that the investigating officer (IO) gave an evasive reply, stating that a notice had been sent to the person concerned to provide the footage to Delhi Police. He added that senior police officials had previously stated they had watched the footage, contrary to the IO’s reply.

The court directed the IO to appear on Friday and issued a notice to the station house officer of Dhaula Kuan Police Station. The hearing will continue on Friday, reported PTI.

Opposing the bail plea, the Delhi Police stated that the accused was not seriously injured despite having admitted herself to the intensive care unit (ICU). They also highlighted that she took the injured to a hospital far away from the spot, which raises serious doubt, according to news agency ANI.

Kaur has been remanded to judicial custody until September 27, and her bail plea is scheduled for Saturday.

The victim, 52-year-old Navjot Singh, served as the deputy secretary in the Department of Economic Affairs and was a resident of Hari Nagar. He succumbed to injuries following the accident, which took place on Ring Road near the Delhi Cantonment Metro station on the afternoon of September 14. Singh and his wife were returning home after visiting Bangla Sahib Gurdwara.

A case has been registered under Sections 281 (rash driving), 125B (endangering life or personal safety of others), 105 (culpable homicide not amounting to murder), and 238 (causing disappearance of evidence) of the BNS.
