A Delhi court has granted bail to Gaganpreet Kaur, the accused in a fatal BMW crash that resulted in the death of a senior Finance Ministry official. The Patiala House Court approved her bail on a bond of ₹1 lakh, along with two sureties.

The court imposed several conditions for her release, including the surrender of her passport and a requirement to be present at every hearing related to the case.

**Ambulance Scrutiny: Questions Raised Over Negligence**

During proceedings, the court questioned the negligence of the ambulance that arrived at the accident site. Although the ambulance reportedly reached within seconds, it failed to take the injured to the hospital promptly.

The court remarked, “What should be done with this ambulance? Are they not accused of the offense of death due to a negligent act?” indicating serious concerns regarding the emergency response.

**Crash Details and Aftermath**

The accident took place near Dhaula Kuan when Gaganpreet Kaur’s BMW collided with a motorcycle carrying Navjot Singh, Deputy Secretary in the Department of Economic Affairs, and his wife, Sandeep Kaur.

Tragically, Singh succumbed to his injuries, while his wife sustained critical injuries. Investigations revealed that the couple was transported to Nulife Hospital in North Delhi, approximately 19 kilometers away from the accident location.

Singh’s family has alleged that valuable time was lost because the victims were not urgently taken to a nearby hospital.

**Legal Proceedings**

Gaganpreet Kaur has been charged with culpable homicide not amounting to murder, among other offenses under the Bharatiya Nyaya Sanhita. She is currently in judicial custody but has now been granted bail under strict conditions.

Kaur defended her actions by stating that she panicked after the accident and took the injured couple to a hospital she was familiar with.

A Delhi court has postponed the bail hearing of Gaganpreet Kaur, the prime accused in a fatal BMW accident that resulted in the death of Deputy Secretary Navjot Singh and injuries to his wife, Sandeep.

The hearing in the Patiala House Court has been deferred to September 24 after the police requested additional time to collect key pieces of evidence, including Kaur’s mobile phone and driving license. Investigators informed Judicial Magistrate Ankit Garg that they oppose granting bail at this stage since the probe is still in its early phases.

**Evidence Collection Underway**

Kaur’s phone, currently held by her husband Parikshit Makkad, is considered crucial for the investigation. The police revealed that the device contains important messages sent after the crash. Makkad is expected to hand over the phone to authorities shortly.

Meanwhile, Gaganpreet Kaur remains in judicial custody until September 27. She faces charges of culpable homicide not amounting to murder and rash driving related to the accident.

**Preservation of CCTV Footage**

The court has also issued a notice on an application seeking the preservation of CCTV footage from the accident site. On Thursday, the court observed that there is no legal provision for sharing such footage with the accused in a criminal case.

The police have registered cases under several penal provisions, including culpable homicide not amounting to murder, rash driving, and negligent driving, following the incident.

**Details of the Incident**

The accident occurred on September 14 around 1:00 PM near Dhaula Kuan. Navjot Singh and his wife were riding a motorcycle back from Bangla Sahib Gurdwara when they were struck by Kaur’s BMW. Parikshit Makkad was seated in the passenger seat of the BMW at the time of the crash.

Authorities are also investigating possible attempts to tamper with evidence after the accident. This includes probing Kaur’s alleged visit to a hospital located nearly 19 kilometers away from the accident site.

The investigation continues as the court awaits further developments before proceeding with the bail hearing.

BMW accident: Delhi court says CCTV footage cannot be shared with accused

Advocate Gagan Bhatnagar, representing Kaur, argued that the case hinged on CCTV footage from Dhaula Kuan metro pillars 65 and 67, and that examining it could reveal additional details. However, the magistrate stated that there is no law permitting the footage to be provided to the accused, reported PTI.

Kaur’s counsel responded, “I am not saying give it to me but to preserve it and submit it in the court.”

Bhatnagar further alleged that the investigating officer (IO) gave an evasive reply, stating that a notice had been sent to the person concerned to provide the footage to Delhi Police. He added that senior police officials had previously stated they had watched the footage, contrary to the IO’s reply.

The court directed the IO to appear on Friday and issued a notice to the station house officer of Dhaula Kuan Police Station. The hearing will continue on Friday, reported PTI.

Opposing the bail plea, the Delhi Police stated that the accused was not seriously injured despite having admitted herself to the intensive care unit (ICU). They also highlighted that she took the injured to a hospital far away from the spot, which raises serious doubt, according to news agency ANI.

Kaur has been remanded to judicial custody until September 27, and her bail plea is scheduled for Saturday.

The victim, 52-year-old Navjot Singh, served as the deputy secretary in the Department of Economic Affairs and was a resident of Hari Nagar. He succumbed to injuries following the accident, which took place on Ring Road near the Delhi Cantonment Metro station on the afternoon of September 14. Singh and his wife were returning home after visiting Bangla Sahib Gurdwara.

A case has been registered under Sections 281 (rash driving), 125B (endangering life or personal safety of others), 105 (culpable homicide not amounting to murder), and 238 (causing disappearance of evidence) of the BNS.
